Article 1 (Purpose)
These Terms and Conditions aim to stipulate the rights, obligations, and responsibilities of the cyber mall and its users when utilizing the internet services (hereinafter referred to as "Services") provided by Save Us Cyber Mall (hereinafter referred to as "Mall"), operated by HwaJin MallTech Co., Ltd. (hereinafter referred to as "Site").
Article 2 (Definitions)
"Mall" refers to the virtual business space established by HwaJin MallTech Co., Ltd. to enable transactions of goods or services (hereinafter referred to as "Goods, etc.") with users via computers and other information and communication devices. The term also represents the business operator managing the cyber mall.
"User" refers to both members and non-members who access the "Mall" and receive services provided by the "Mall" under these Terms and Conditions.
"Member" refers to a person who has registered as a member of the "Mall" and can continuously utilize the services provided by the "Mall."
"Non-member" refers to a person who uses the services provided by the "Mall" without registering as a member.
Article 3 (Specification, Explanation, and Amendment of Terms and Conditions)
The "Mall" shall display the contents of these Terms and Conditions, the company's name, representative's name, address of the business (including the address where consumer complaints can be handled), phone number, fax number, email address, business registration number, e-commerce registration number, and the personal information management officer, in a manner that users can easily view on the initial service screen of the "Mall" (front page). However, the contents of the Terms and Conditions can be accessed by the user through a connected screen.
Before obtaining the user's consent to these Terms and Conditions, the "Mall" must provide a separate screen or pop-up screen to allow users to understand essential details such as withdrawal of consent, delivery responsibility, and refund conditions.
The "Mall" may amend these Terms and Conditions to the extent that it does not violate relevant laws such as the Act on the Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Consumer Protection Act.
If the "Mall" amends the Terms and Conditions, it shall specify the application date and the reason for the amendment and notify users by posting the current and revised Terms and Conditions on the initial screen of the "Mall" from 7 days prior to the application date until the day before the application date. If the amendment is unfavorable to the users, a grace period of at least 30 days shall be provided, and the "Mall" shall clearly compare the differences between the previous and revised Terms for the users' easy understanding.
When the "Mall" amends the Terms and Conditions, the revised Terms shall only apply to contracts concluded after the application date, and for contracts already concluded, the previous Terms shall apply. However, if an already contracted user wishes to apply the revised Terms, they may notify the "Mall" within the amendment notice period, and the "Mall" may agree to the request.
Any matters not specified in these Terms and Conditions and the interpretation thereof shall be governed by the Act on the Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, consumer protection guidelines set by the Fair Trade Commission, and relevant laws or customary practices.
Article 4 (Provision and Change of Service)
The "Mall" shall perform the following tasks:
Provide information on goods or services and conclude purchase contracts.
Deliver goods or services for which purchase contracts have been concluded.
Other tasks determined by the "Mall."
If the goods or services are sold out or technical specifications change, the "Mall" may change the content of the goods or services to be provided in future contracts. In such cases, the "Mall" shall immediately notify the users by posting the changed goods or services' content and delivery date where the current goods or services are posted.
If the "Mall" changes the content of the services it has contracted with the user to provide due to reasons such as goods being sold out or technical specification changes, it shall immediately notify the user at a reachable address.
In the case of the preceding paragraph, the "Mall" shall compensate users for damages caused by such changes. However, the "Mall" shall not be liable if it proves there was no intentional or negligent fault on its part.
Article 5 (Suspension of Service)
The "Mall" may temporarily suspend the provision of services due to maintenance, replacement, or failure of computers or other information communication equipment, or interruption of communication.
The "Mall" shall compensate users or third parties for damages incurred due to the temporary suspension of service as described in paragraph 1. However, the "Mall" shall not be liable if it proves there was no intentional or negligent fault on its part.
If the "Mall" can no longer provide services due to changes in business items, abandonment of business, or mergers between companies, it shall notify users in the manner specified in Article 8 and compensate consumers under the conditions initially offered by the "Mall." If the "Mall" has not provided compensation criteria, it shall compensate users by paying them in cash or providing equivalent physical goods for the mileage or points they accumulated in the "Mall."
Article 6 (Membership Registration)
Users can apply for membership by filling out the registration form provided by the "Mall" and expressing their consent to these Terms and Conditions.
The "Mall" shall register users as members unless they fall under any of the following cases:
If the applicant has previously lost membership under Article 7, paragraph 3 of these Terms and Conditions. However, exceptions are made if the applicant has been reapproved by the "Mall" after 3 years from the loss of membership.
If there are false, omitted, or incorrect entries in the registration details.
If registering the user as a member is technically challenging for the "Mall."
The membership contract is considered established when the "Mall" sends a notification of acceptance to the member.
If there are changes in the registered information, the member shall promptly notify the "Mall" by modifying their information.
Article 7 (Withdrawal and Disqualification of Membership)
Members may request withdrawal from membership at any time, and the "Mall" shall immediately process the withdrawal.
The "Mall" may restrict or suspend membership if the member:
Provided false information during registration.
Does not pay the purchase price or other obligations related to the "Mall."
Interferes with others' use of the "Mall" or steals their information, disrupting e-commerce order.
Uses the "Mall" to engage in illegal activities or activities that violate these Terms and Conditions.
If the same act is repeated twice or more within 30 days after the "Mall" restricts or suspends membership, or if the reason for such action is not corrected within 30 days, the "Mall" may terminate the membership.
When the "Mall" terminates the membership, it shall delete the member's registration. In such cases, the "Mall" shall notify the member and give them a minimum of 30 days to explain themselves before deletion.
Article 8 (Notification to Members)
When the "Mall" needs to notify members, it may do so via the email address provided by the member.
For notifications to unspecified members, the "Mall" may substitute individual notifications by posting the information on the "Mall" notice board for more than one week. However, individual notifications shall be made for matters that significantly impact the member's transaction.
Article 9 (Purchase Request and Consent to Provide Personal Information)
Users request purchases through the "Mall" using methods such as:
Searching and selecting goods, etc.
Entering the recipient's name, address, phone number, email address, etc.
Confirming details about the Terms and Conditions, services with restricted withdrawal rights, delivery costs, and installation fees.
Indicating agreement to the Terms and Conditions and confirming the above.
Requesting a purchase and confirming this request.
Selecting a payment method.
If the "Mall" needs to provide personal information to a third party, it must inform the user and obtain consent for items including:
The recipient of the information.
The purpose of using the information.
The items of personal information provided.
The retention and use period of the information. If any changes occur, the "Mall" must also inform and obtain consent from the user.
If the "Mall" delegates the handling of personal information, it must inform the user and obtain consent, including details on:
The recipient of the delegation.
The delegated tasks. However, if the delegation is necessary for fulfilling service contracts or enhancing user convenience, the "Mall" may inform users via the privacy policy without additional notification or consent procedures.
Article 10 (Formation of Contract)
The "Mall" may not accept the purchase request in the following cases:
If there is any falsehood, omission, or error in the application.
If a minor is attempting to purchase goods prohibited by law, such as tobacco or alcohol.
If the "Mall" finds that accepting the request may significantly impede its technology or operations.
A contract is considered formed when the "Mall" delivers a confirmation notice to the user as outlined in Article 12, Section 1.
The "Mall"’s acceptance must include information such as confirmation of the user's purchase request, availability of the items, and guidance on any corrections or cancellations.
Article 11 (Payment Methods)
Payment for goods or services purchased from the "Mall" can be made using one of the following methods. The "Mall" shall not impose any additional fees on the payment methods:
Bank transfers (e.g., phone banking, internet banking, mail banking).
Payments by prepaid cards, debit cards, or credit cards.
Online deposit without a bankbook.
Payments by electronic currency.
Payment upon receipt.
Payment using points or mileage provided by the "Mall."
Payments via gift certificates contracted with or recognized by the "Mall."
Other electronic payment methods.
Article 12 (Confirmation Notice and Changes/Cancellations)
The "Mall" will send a confirmation notice to the user upon receiving a purchase request.
Users may request changes or cancellations if there is any discrepancy in their purchase request upon receiving the confirmation notice. The "Mall" must process the request promptly if it is made before shipping. However, if payment has already been made, the process will follow the provisions related to withdrawal of offers in Article 15.
Article 13 (Supply of Goods)
Unless otherwise agreed upon, the "Mall" will take the necessary steps to deliver the ordered goods within 7 days from the date the user made the purchase. If the "Mall" has received full or partial payment, it will start the necessary actions within 3 business days after receiving the payment.
The "Mall" will specify the delivery methods, the responsible party for delivery costs, and the expected delivery period. If the "Mall" exceeds the agreed delivery time, it will compensate the user for any resulting damages unless it can prove it was not at fault.
Article 14 (Refunds)
If the "Mall" is unable to deliver the ordered goods due to stock shortage or other reasons, it will notify the user immediately and, if payment has been made, refund the payment within 3 business days or take necessary actions for the refund.
Article 15 (Withdrawal of Offer)
Users who have entered into a contract with the "Mall" for the purchase of goods may withdraw their offer within 7 days of receiving a written contract as per the Electronic Commerce Consumer Protection Act. However, if otherwise stated by law, the legal provisions will apply.
Users cannot request a refund or exchange in the following cases:
If the goods are lost or damaged due to reasons attributable to the user (unless the damage was due to inspecting the contents).
If the value of the goods has significantly decreased due to use or partial consumption by the user.
If the value of the goods has significantly decreased over time, making resale difficult.
If the packaging of goods that can be duplicated has been damaged.
If the "Mall" did not clearly inform the user of the limitations on withdrawing offers or provided trial products, users’ right to withdraw offers will not be restricted.
Users may withdraw their offer within 3 months of receiving the goods or within 30 days of discovering a discrepancy if the goods do not match the advertised description or contract terms.
Article 16 (Effects of Withdrawal of Offer)
The "Mall" will refund the user within 3 business days of receiving returned goods. If delayed, the "Mall" will pay interest on the delayed amount as prescribed by law.
If payment was made by credit card or electronic currency, the "Mall" will promptly request the relevant payment service provider to stop or cancel the payment.
The cost of returning goods due to withdrawal of the offer is borne by the user unless the goods are returned due to discrepancies with the advertisement or contract, in which case the "Mall" will bear the cost.
If the user paid for shipping when receiving goods, the "Mall" will clearly state who will bear the cost of shipping in case of withdrawal of the offer.
Article 17 (Protection of Personal Information)
The "Mall" will collect the minimum personal information necessary for providing services.
The "Mall" will not collect information required for executing the purchase contract during membership registration. However, the "Mall" may collect minimal personal information if identity verification is required before the purchase contract according to the relevant laws.
When collecting and using personal information, the "Mall" will notify users of the purpose and obtain their consent.
The "Mall" will not use the collected personal information for any purpose other than what was initially intended, and if a new purpose arises or the information is to be shared with a third party, the "Mall" will notify the user and obtain consent.
If the "Mall" is required to obtain consent under Sections 2 and 3, it will clearly notify the user of the information required by law, including the identity of the person responsible for managing personal information, the purpose of collection and use, and details related to the provision of information to third parties. Users may withdraw their consent at any time.
Users may request to view or correct their personal information held by the "Mall" at any time, and the "Mall" must take action without delay. If a user requests a correction, the "Mall" will not use the personal information until the correction is made.
The "Mall" must limit access to personal information to a minimum and is responsible for any loss, theft, leakage, unauthorized provision, or tampering of personal information, including credit card and bank account details.
The "Mall" or any third party receiving personal information must destroy the information promptly once the purpose of collection or provision is fulfilled.
The "Mall" will not pre-select consent options for collecting, using, or providing personal information. If a user refuses consent, the "Mall" must clearly state any service limitations and cannot deny service or membership based on refusal to consent to non-essential information collection.
Article 18 (Obligations of the "Mall")
The "Mall" will strive to continuously and stably provide goods and services as per this agreement and in compliance with laws and public order.
The "Mall" must have a security system in place to protect users' personal information, including credit information, ensuring safe internet usage.
If the "Mall" causes damage to users by engaging in false or misleading advertising as defined by law, it will compensate for the damage.
The "Mall" will not send commercial electronic mail that users do not wish to receive.
Article 19 (Member’s ID and Password Obligations)
Members are responsible for managing their ID and password, except as stated in Article 17.
Members must not allow third parties to use their ID and password.
If a member becomes aware that their ID and password are being used by a third party, they must immediately notify the "Mall" and follow its guidance.
Article 20 (User Obligations)
Users must not engage in the following actions:
Registering false information when applying or changing details.
Stealing information from others.
Changing information posted on the "Mall."
Transmitting or posting information (such as computer programs) other than what the "Mall" specifies.
Infringing on the "Mall" or third-party intellectual property rights.
Damaging the reputation or interfering with the operations of the "Mall" or third parties.
Posting obscene or violent messages, images, or audio that violate public order.
Article 21 (Copyright Ownership and Use Restrictions)
Copyright and other intellectual property rights of works created by the "Mall" belong to the "Mall."
Users may not use or allow third parties to use the information obtained through the "Mall" for commercial purposes without prior consent from the "Mall."
If the "Mall" uses copyrighted works owned by users according to an agreement, it must notify the user.
Article 22 (Dispute Resolution)
The "Mall" will establish and operate a damage compensation mechanism to handle legitimate complaints or disputes raised by users.
The "Mall" will prioritize the handling of complaints and disputes. If it is difficult to resolve promptly, the "Mall" will notify the user of the reason and the expected timeline.
In the event of a dispute arising from electronic transactions, if a user files a complaint for damages, the case may be resolved through mediation by a dispute resolution agency designated by the Fair Trade Commission or the local government.
Article 23 (Jurisdiction and Governing Law)
Lawsuits arising from disputes between the "Mall" and users regarding electronic transactions will be under the jurisdiction of the court where the user resides at the time
